Atiku Takes Tinubu to Court Over Alleged NYSC Certificate Discrepancy

Former Vice-President Atiku Abubakar has taken his challenge against President Bola Ahmed Tinubu's eligibility for the 2027 presidential election to court, asking the Federal High Court in Abuja to examine allegations surrounding an NYSC discharge certificate linked to the President.

Atiku, who is the presidential candidate of the African Democratic Congress (ADC), filed the suit alongside his party on Friday, August 14, 2026. The All Progressives Congress (APC) and the Independent National Electoral Commission (INEC) are also named as defendants.

The case centres on an NYSC discharge certificate which Atiku alleges was submitted to INEC and bears the name “Tinubu Bola Adekunle”, rather than the name Bola Ahmed Tinubu.

Atiku is asking the court to determine whether the document was genuinely obtained by Tinubu and whether the alleged discrepancy has consequences under Nigeria's constitutional requirements for presidential candidates.

Atiku seeks 2027 disqualification

At the heart of the suit is Section 137(1)(j) of the 1999 Constitution, which concerns the presentation of a forged certificate to INEC for the purpose of contesting a presidential election.

The plaintiffs are asking the court to determine whether the facts alleged in their case meet the constitutional threshold for disqualification from the 2027 presidential election. They are also relying on provisions of the Electoral Act 2026 in their legal arguments.

The case therefore does not amount to a judicial finding that President Tinubu forged an NYSC certificate. Those are allegations contained in the case, and the court will have to consider the evidence and arguments before reaching any determination.

INEC records also in focus

Atiku and the ADC are also asking the court to compel INEC to produce Tinubu's Form CF001, the nomination document submitted in connection with the presidential elections.

According to reports on the suit, Atiku said he had previously sought certified true copies of the relevant documents from the electoral commission but did not receive a response before commencing the court action.

The former Vice-President personally appeared at the Federal High Court registry in Abuja on Friday to depose to an affidavit supporting the case.

He said the decision to approach the court was intended to move the dispute away from political and social-media arguments and toward examination of the evidence.

“If the certificate belongs to Bola Ahmed Tinubu, let that be established before the court,” Atiku said, according to reports of his remarks. “If ‘Tinubu Bola Adekunle’ and ‘Bola Ahmed Tinubu’ are one and the same person for the purpose of that certificate, let the evidence establish it.”

A new legal battle ahead of 2027

The lawsuit adds another legal and political dimension to the growing contest ahead of the 2027 presidential election.

Atiku's case comes as opposition parties continue to challenge aspects of President Tinubu's eligibility and record, while the administration and its supporters have repeatedly defended the President against allegations concerning his qualifications and official documents.

For now, however, the NYSC certificate allegations remain matters for determination by the court. The filing of a lawsuit does not itself establish that the document was forged or that Tinubu is disqualified from contesting the election.

The Federal High Court will have to consider the documents, constitutional provisions and arguments presented by the parties before determining the issues raised by Atiku and the ADC.
